CEEEC accepts and comments on Polish proposal to regulate wholesale broadcasting
Polish regulator UKE announced the end of the consolidation procedure on the draft decisions imposing obligations on the provider EmiTel, as an operator with significant market power on the national wholesale market for radio and TV broadcast transmission services.
The European Commission accepted the proposed regulation and had two comments. One of them was that the UKE did not consider it appropriate to define a separate relevant market for access to (passive) infrastructure, such as towers and masts, consequently it did not evaluate directly the competitive conditions of the upstream market in relation to the market for provision of broadcasting services. The Commission encourages UKE to take the opportunity, during the next market review to make a clear distinction between the infrastructure that can be duplicated and that which are necessary for provision of national or regional broadcasting services. The second comment of the EC was that UKE did not set a cost calculation methodology to be applied for the cost-oriented prices. RELATED
